Intellectual property

All elements of the site (texts, photographs, illustrations, logos, files available for download, graphic charter, computer code, etc.) are the exclusive property of BaptistoBook or its credited sources. These elements are protected by French laws and international texts relating to the respect of author's rights and copyright. The Intellectual Property Code considers in particular as works of the mind, under the terms of 9° of art. L. 112-2, “photographic works and those produced using techniques analogous to photography”.

The author alone has the right to disclose his work. Subject to the provisions of art. L. 132-24, it determines the method of disclosure and sets the conditions thereof. (art. L. 121-2 of the CPI) Any representation or reproduction in whole or in part, made without the consent of the authors or their successors in title or assigns, is unlawful. The same applies to translation, adaptation or transformation, arrangement or reproduction by any art or process whatsoever (art. L. 122-4 of the CPI). This prohibition extends, without this list being exhaustive, to any editorial element appearing on the site: presentation of screens, texts, logos, photographs in particular.

A person who reproduces a work without the authorization of the authors in order to make it available to the public commits an act of counterfeiting.

Any edition of writings, musical composition, drawing, painting or any other printed or engraved production in whole or in part, in defiance of the laws and regulations relating to the property of the authors, is an infringement; and any counterfeiting is an offense (art. L. 335-2 of the CPI).

Any reproduction, representation or distribution, by any means whatsoever, of an intellectual work in violation of the copyright, as defined and regulated by law (art. L. 335-3 of the CPI).

Counterfeiting is a civil offense (liable to damages), and a criminal offense (liable to imprisonment for three years and a fine of 300,000 euros). The Intellectual Property Code does not authorize, under the terms of paragraphs 1 and 2 of art. L. 122-5, that private and free performances performed exclusively within a family circle, copies or reproductions strictly reserved for the private use of the copyist and not intended for collective use.
